Article 1 – Definitions
1.1 In these terms and conditions, the following definitions apply:

Entrepreneur: The legal entity Tormino B.V., located at 's-Gravendamseweg 67 L

2215 TG Voorhout, Netherlands, registered with the Chamber of Commerce under number 84663545.

Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance agreement with the entrepreneur.

Distance Agreement: An agreement in which, within the framework of a system organized by the entrepreneur for the distance selling of products and/or services, one or more techniques for remote communication are exclusively used up to and including the conclusion of the agreement.

Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.

Right of Withdrawal: The consumer's ability to rescind the distance agreement within the cooling-off period.
Article 2 – Applicability
2.1 These general terms and conditions apply to every offer made by the entrepreneur and to any distance agreement formed between the entrepreneur and the consumer.
2.2 Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the general terms and conditions can be reviewed, and that they will be sent to the consumer free of charge upon request.
Article 3 – The Sacrifice
3.1 The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to make an informed evaluation of the offer.
3.2 Obvious mistakes or errors in the offer do not bind the entrepreneur.
3.3 Each offer contains information that makes it clear to the consumer what rights and obligations are linked to the acceptance of the offer.
Article 4 – The Agreement
4.1 The agreement is concluded when the consumer accepts the offer and meets the conditions set forth therein.
4.2 If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically.
Article 5 – Right of Withdrawal
5.1 The consumer can dissolve an agreement concerning the purchase of a product within a cooling-off period of 14 days without providing any reason.
5.2 The cooling-off period starts on the day after the consumer receives the product.
5.3 During the cooling-off period, the consumer will handle the product and packaging with care. They will only unpack or use the product to the extent necessary to determine its nature, characteristics, and functioning.
Article 6 – Obligations of the Consumer During the Cooling-off Period
6.1 The consumer is only liable for the depreciation of the product resulting from handling the product in a way that goes beyond what is necessary as described in Article 5.3.
Article 7 – Exercising the Right of Withdrawal by the Consumer and Costs
7.1 If the consumer exercises their right of withdrawal, they must notify the entrepreneur within the cooling-off period using the model withdrawal form or in another clear manner.
7.2 As soon as possible, but within 14 days from the day following the notification mentioned in paragraph 1, the consumer will return the product or deliver it to the entrepreneur.
7.3 The consumer bears the direct costs of returning the product.
Article 8 – Prices
8.1 The prices mentioned in the offer of products or services include VAT.
8.2 During the validity period specified in the offer, the prices for the offered products and/or services will not be increased, except for price changes resulting from changes in VAT rates.
Article 9 – Complaints Procedure
9.1 Complaints about the performance of the agreement must be submitted in full and clearly to the entrepreneur within a reasonable time.
9.2 Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt.
9.3 If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed reply.
Article 10 – Applicable Law
10.1 Dutch law exclusively applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply.
Article 11 – Additional or Deviating Provisions
11.1 Additional or deviating provisions from these general terms and conditions must not disadvantage the consumer and must be recorded in writing so that they can be stored by the consumer in an accessible manner on a durable data carrier.
